Domestic Violence is a very serious issue in New Jersey. Domestic Violence can be both physical violence, harassment, and repeated threats of bodily injury. No one should ever have to feel afraid in their own home. More importantly, no one has the right to hurt anyone else, even if they are a family member.

The Domestic Violence Law protects victims who are 18 years of age or older or any emancipated minor, against acts of Domestic Violence committed by someone (called a Defendant) who can be a spouse, ex-spouse or is a present or former household member or a person with whom a victim has a present, or past,dating relationship.

Help is Available

If you are afraid, you do not have to wait to be physically injured before you seek help. Help is available 24 hours every day to anyone who believes that he or she is a victim of Domestic Violence. A victim has the right to apply to a court to obtain a Temporary Restraining Order by calling a local police department. A Judge will grant the Temporary Restraining Order if the victim proves that restraints are necessary to protect the life, health or well-being of the victim. The Order may prohibit the Defendant from returning to the scene of the Domestic Violence, grant temporary custody, temporary support, emergency funds, order counseling, anger management counseling, or drug testing, and may require the search and seizure of weapons and any other appropriate relief. After hearing the testimony from the victim, the Judge will issue or deny the Temporary Restraining Order. If the Judge grants the Temporary Restraining Order, a date to make the Restraining Order permanent ( called a Final Order) is set. On the date set for the "Final Order" the victim must appear in Court and the Court will hear the testimony of both the victim and the defendant before deciding whether to make the Restraining Order permanent.
